If you are convicted of DUI, you could be subject to the following penalties under Georgia law:

1st OFFENSE

Jail Time: 24 hours to 1 year

Fines:

  • Minimum $300, Maximum $1,000
  • Minimum $200 for license reinstatement

License Suspension: Minimum 120 days, up to 1 year

Community Service: Minimum of 40 hours

Mandatory Programs:

  • Risk Reduction School
  • Drug and Alcohol Evaluation

Probation: 12 Months

2nd OFFENSE WITHIN 10 YEARS OF FIRST OFFENSE

Jail Time: 3 days to 1 year

Fines:

  • Minimum $600, Maximum $1,000
  • License reinstatement fee $210

License Suspension: 1 year

Community Service: Minimum of 200 hours

Mandatory Programs:

  • Risk Reduction School
  • Substance Abuse Treatment

Probation: Varies

3rd OFFENSE WITHIN 10 YEARS OF SECOND OFFENSE

Jail Time: 15 days to 1 year

Fines: Minimum $1000, Maximum $5000

License Suspension: 5 years

Community Service: Minimum of 200 hours

Mandatory Programs:

  • Risk Reduction School
  • Clinical Evaluation – plus a possible completion of substance abuse treatment

Probation: Varies

Other:

  • Embarrassment – your name, photo, and address published in the local newspaper at your expense
  • You will be declared a habitual violator
  • Your license plate will be seized and sent to the Department of Motor Vehicle Safety

4th OFFENSE WITHIN 10 YEARS OF THIRD OFFENSE (Automatically becomes Felony)

Jail Time: 1 year to 5 years

Fines: Minimum $1000, Maximum $5000

License Suspension: 5 years

Community Service: Minimum of 200 hours

Mandatory Programs:

  • Risk Reduction School
  • Clinical Evaluation – plus a possible completion of substance abuse treatment

Probation: Varies

Other:

  • Embarrassment – your name, photo, and address published in the local newspaper at your expense
