Georgia’s Burglary Laws

First Degree Burglary

First-degree burglary is the most serious type of burglary and is punishable by up to 20 years of prison. It involves breaking and entering into a dwelling with the intent to commit a felony or theft.

Second Degree Burglary

Second-degree burglary is a less serious crime and is punishable by a minimum of one year in prison and a maximum 5 years of prison. It involves entering a vehicle or other structure without consent with the intent to commit a felony or theft. Essentially, if a building is ‘dwelling’ then it is first-degree.

 

What is a 'dwelling?'

Per GA code 16-7-1 a dwelling ‘means any building, structure, or portion thereof which is designed or intended for occupancy for residential use.’
