What is Embezzlement?

Embezzlement is a crime usually associated with the broad term of ‘white-collar crime.’ These are crimes that usually are non-violent and are associated directly with receiving a financial or business gain. Essentially, embezzlement is when someone unlawfully takes money or assets that they have been entrusted with. Usually, this charge is associated with money but any form of an asset can be embezzled, including property and other valuables. 

These charges are generally associated with individuals within a company or business that have been tasked or entrusted with access to funds. While they’re entrusted to manage or use these funds in a certain way pertaining to the business, they can be accused of embezzlement if the assets are misused. 

As with other white-collar and financial criminal charges, cases of this nature can be very complex. They usually involve a combination of financial documents and detailed investigations. Being accused of embezzlement typically revolves around the use of money, real property, or company assets for personal use, or for use strictly outside what’s within someone’s purview.

Georgia’s Laws on Embezzlement

Penalties for Embezzlement vary depending on what was alleged to be stolen and how much is was worth. In Georgia, the term ‘Embezzlement’ is not used in statutes related to this kind of criminal offense. Instead, Georgia uses the term ‘conversion’ or ‘theft by conversion.’ For this crime to be proven these elements must be present:

  • Someone must lawfully acquire another person’s assets, including leased or rented property
  • This person is legally obligated or has agreed to use the assets in a specific way
  • They then knowingly take the assets and use them for their own personal gain thus violating their legal obligation

Charges of embezzlement and their potential punishments deal with the worth of the stolen property. 

  • $500 or less: Up to a year of imprisonment and $1,000 fine
  • More than $500: Up to 5 years imprisonment and $5,000
  • Breaching fiduciary duty: Embezzling public or private money and breaching a fiduciary duty could result in up to 15 years of imprisonment and a fine of $100,000
